Terms and Conditions for the Strategy Explorer Online Master Class

The following terms and conditions apply to the Strategy Explorer Online Master Class, organized by Dr. Stefan Pastuszka, Berliner Ring 23, 63512 Hainburg, Germany; email address: info@pastuszka.de.

1) Registration

Registration for the Online Master Class takes place via email to info@pastuszka.de. The following information is required for registration:

  • Declaration of intention to book (e.g., “I hereby register for the Master Class in [month]…”)
  • Desired variant: with or without personal strategy coaching?
  • Name of the participant
  • Complete company address and billing address with telephone number and email address

The registration is binding and will be considered in the order in which it is received. After registration and verification by the organizer, the participant will receive a written booking confirmation (by email), provided that a free place is available and the participant is admitted to the event. If this is not the case, the participant will be informed. The booking becomes binding for both parties with the booking confirmation, thus concluding the contract.

The contract is subject to the condition subsequent that the minimum number of participants specified in the course description is reached (see also Section 5). In addition, the organizer can reject a registration for the master class without giving reasons.

2) Billing and Payment

After receipt of the registration, the participant(s) will receive an invoice for the advertised participation fee. The participant agrees to electronic invoicing. According to the legal requirements, an electronic invoice is only sent again in the form of a duplicate.

As noted on the invoice, the seminar fee is due for payment immediately and without deduction. Participants with invoices that have not been paid in full will not be admitted to the course. The participation fee specified in the seminar description usually also includes all working documents. Exact details can be found in the seminar description.

3) Cancellation by the participant

A withdrawal from the contract is possible at any time. A withdrawal must be declared in writing, text form (email or letter) is sufficient.

In the event of a withdrawal, we charge the following processing fees:

  • Cancellation up to 30 days before the start of the first session: € 250 plus VAT.
  • Cancellation from 30 days before the start of the first session: 50% of the participation fee plus VAT.
  • Cancellation from 14 days before the start of the first session: the full participation fee plus VAT.
  • This also applies if the registered participant fails to appear.

This regulation applies in the event that no other person suitable for participation is named. The participant has the right to nominate another person suitable to participate in the seminar. This is possible up to 1 week before the start of the first course session. In this case, the organizer must issue a confirmation for the substitute participant. This can only be refused for important reasons. There are no costs for rebooking to the replacement person.

For consumers within the meaning of §13 BGB, this regulation only applies after the end of the statutory cancellation period.

4) Right of withdrawal for consumers

If the contract is concluded with the help of a means of distance communication, the participant, insofar as he/she is a consumer within the meaning of the Consumer Protection Act (i.e. he/she acts when concluding the contract for purposes that are not attributed to his/her professional or commercial activity), has a statutory right of withdrawal within the meaning of the EU Consumer Rights Directive 2011/83/EU.

The withdrawal period is deemed to have been met if the declaration of withdrawal is sent within the period. The participant has the right to revoke the contract within 14 days of the conclusion of the contract without giving reasons. Saturdays, Sundays and public holidays count. This does not apply to events that begin within these 14 calendar days of the conclusion of the contract. In order to exercise the right of withdrawal, the participant must inform the organizer of his/her decision to withdraw from the contract by means of a clear statement. The written declaration of withdrawal is to be addressed to the organizer.

If the contract is revoked, the organizer will reimburse all payments received from the participant immediately and at the latest within fourteen days from the day on which the notification of the revocation of the contract was received. The same means of payment will be used for the repayment that the participant used in the original transaction, unless expressly agreed otherwise; under no circumstances will fees be charged for this repayment.

5) Event cancellation by the organizer

The number of participants is limited to ensure that the Online Master Class can be carried out efficiently and to maintain a high quality standard. In addition, the organizer points out that the implementation of the Strategy Explorer Master Class depends on reaching a minimum number of participants on a specific date. If the event is canceled because the number of participants falls below this minimum number, this will be done no later than two weeks before the start of the first Master Class Session. The participant will then be reimbursed the seminar price. This also applies as a result of force majeure or illness of the speaker. Except in the case of intent and gross negligence, the organizer will not be liable for wasted expenses or similar disadvantages as a result of a cancellation.

6) Service

The Strategy Explorer Master Class will be conducted by the organizer according to the announcement with the help of remote communication means (“online”). For this purpose, he provides the participants with access to the communication system appropriate for the program. The organizer is free to choose the respective communication system, provided that this complies with the legal requirements.

The participant is responsible for the technical requirements for access to the means of long-distance communication, in particular with regard to the functionality of the hardware he uses and the means of communication he uses, especially with regard to an appropriate connection speed. The organizer does not provide the participants with any hardware or access to a means of communication.

The organizer provides the services included in the course description. The content of the Strategy Explorer Master Class can be changed during the program by the organizer for the benefit of the participants and the overall program success.

Content, dates and objectives of the individual strategy coachings are individually agreed between the respective participants and Dr. Stefan Pastuszka.

7) Liability

The organizer is only liable for any damage that arises if this is based on a breach of an essential contractual obligation or on intentional or grossly negligent behavior by the organizer, his legal representatives or vicarious agents. If an essential contractual obligation is violated through slight negligence, liability is limited to the foreseeable damage typical of the contract. An essential contractual obligation exists in the case of obligations whose fulfillment are required to enable the proper execution of the contract or on whose observance the customer has relied and was entitled to rely. Any further liability for damages is excluded. Liability for culpable injury to life, limb or health under the statutory provisions remains unaffected. This also applies to mandatory liability under the Product Liability Act.

8) Copyright & Personal Rights

The documents and content transmitted by the organizer to the participants are subject to copyright protection. They may only be used within the narrow limits of copyright law, in particular for personal use.

The rights arising from this, in particular reprinting and duplication, reproduction by photomechanical or similar means and storage in data processing systems, remain reserved for the organizer, even if only excerpts are used. Image and sound recordings during the event require the written consent of the organizer before the start of the event.

9) Privacy

By registering, the participant agrees to the processing of his/her personal data for the purpose of holding the event. In particular, the participant agrees that his/her data will be stored electronically by the organizer for internal processing, billing and information purposes and that he/she will be informed by post or email about further events from the organizer. The participant can object to the use of his/her data for further information

The participant agrees that photos taken during the event may be published. The participant can revoke this consent at any time. The written form (letter or e-mail) is required for this.

10)  Place of Performance/Jurisdiction

The place of performance for payments is the organizer’s registered office in Hainburg, the exclusive place of jurisdiction is Seligenstadt, Germany.

11)  Final Provisions

Should individual provisions of the contract with the customer, including these general terms and conditions, be or become invalid in whole or in part, this does not otherwise affect the validity of these conditions or a contract concluded on them. In such a case, the contracting parties will agree on an effective provision in place of the ineffective provision, which comes as close as possible to the regulatory purpose of the original provision in economic terms. The same applies in the case of an incomplete regulation.
